Please read this document carefully before participating. In registering to play or use our courts, you acknowledge and accept the risks associated with participation in sporting and recreational activities and understand that I play at my own risk.
I acknowledge that participation in sporting and recreational activities involves inherent risks, including but not limited to physical injury, illness, permanent disability, or death. I understand these risks may arise from my own actions, the actions of others, the condition of the premises, or the nature of the activity itself.
I confirm that I am voluntarily participating in activities at the Indoor Sports Centre and that I am physically fit and medically able to participate. I agree that I am responsible for monitoring my own condition and will stop participating if I believe continued participation may be unsafe.
I consent to receive medical treatment in the event of injury or illness during participation, including first aid or emergency treatment, and I agree to be responsible for any associated costs.
To the fullest extent permitted by law, I release, discharge, and indemnify the Indoor Sports Centre, its owners, directors, employees, contractors, volunteers, and agents from any claims, demands, actions, or liabilities arising from my participation, except where liability cannot be excluded by law.
This agreement is made pursuant to section 139A of the Competition and Consumer Act 2010 (Cth). By signing this form, I agree that the Indoor Sports Centre is not liable for death or personal injury suffered by me resulting from the supply of recreational services, except where the law prevents such exclusion.
Where the participant is under 18 years of age, this form must be completed by a parent or legal guardian, who agrees to the terms of this waiver on behalf of the minor.
This agreement is governed by the laws of Queensland, Australia.
Kawana Indoor Sports — Terms & Conditions for Court Hire
These Terms and Conditions govern the hire and use of the indoor sports court facilities (“Facility”) operated by Kawana Indoor Sports (“Management”, “we”, “us”, “our”).
By booking or using the Facility, the Hirer (“you”, “your”) agrees to comply with these Terms and Conditions.
1.1 All bookings must be made in advance through our approved booking system.
1.2 A booking is confirmed only upon receipt of full payment or required deposit.
1.3 Payment must be made via approved payment methods.
1.4 Prices are subject to change without prior notice, except for confirmed bookings.
1.5 Court hire fees cover court use only. No equipment is included in the hire fee. Hirers must bring their own sporting equipment unless otherwise agreed in writing.
2.1 Bookings must cannot start until the allocated time and must finish 5 minutes before the finish time to allow for pack up and changeover of hirers
2.2 Setup and pack-down time must be included within the booked session.
2.3 Overtime use without prior approval will result in additional charges.

3.2 Kawana Indoor Sports reserves the right to cancel bookings due to unforeseen circumstances (e.g., maintenance, safety issues). In such cases, a full refund or rescheduling option will be offered.
4.1 Please note that most court hire occurs outside staffed periods and it is your responsibility to ensure you have the necessary codes etc to access the facility. You also need to lock it up upon completion.
4.2 The bar is generally not open for court hire bookings. You must NOT BYO alcohol as we are not licensed for this.
4.3 The courts may only be used for their intended sporting purpose.
4.4 No food is permitted on the courts at any time. Food and beverages must remain in designated areas only.
4.5 Smoking, vaping, and illegal substances are strictly prohibited inside the Facility.
4.6 The beach volleyball court is strictly for volleyball games only and must not be used as a play area for children or for non-volleyball activities.
5.1 Appropriate sporting attire must be worn at all times.
5.2 Standard sports/running shoes are permitted.
5.3 Shoes with spikes or studs are strictly prohibited on all indoor courts.
6.1 Hirers are responsible for leaving the Facility clean and tidy after their booking.
6.2 All rubbish must be removed and placed in the designated garbage bags and bins provided.
6.3 Cleaning equipment, including dustpan, broom, mop, and garbage bags, is located near the bar
6.4 Any spills must be cleaned immediately to prevent hazards.
6.5 A cleaning fee will be charged if the Facility is left in an unsatisfactory condition.
7.1 Equipment is not included in the court hire fee unless otherwise agreed.
7.2 Hirers must provide their own equipment.
7.3 Any equipment belonging to Kawana Indoor Sports must be used appropriately and returned in good condition if supplied by prior arrangement.
7.4 OUTDOOR CRICKET BALLS ARE NOT TO BE USED unless approval has previously been sought.
8.1 The Hirer is responsible for any damage caused to the Facility during their booking.
8.2 Damages beyond normal wear and tear will be assessed and billed to the Hirer.
8.3 Kawana Indoor Sports reserves the right to charge for repairs, replacement, or additional cleaning required due to misuse.
9.1 The Hirer is responsible for the behaviour of all participants and spectators.
9.2 Children under 16 must be supervised by a responsible adult.
9.3 Disorderly, unsafe, or abusive behaviour will result in immediate removal without refund.
9.4 Kawana Indoor Sports reserves the right to refuse entry or terminate use at its discretion for safety or policy breaches.
10.1 All users participate at their own risk and it is the responsibility of hirers to have their own insurance
10.2 The Hirer must ensure participants are physically fit and capable of participating.
10.3 Emergency exits must remain unobstructed at all times.
10.4 A first aid kit is located at behind the bar
10.5 Any injuries or incidents must be reported immediately to Management.
11.1 Kawana Indoor Sports shall not be liable for any personal injury, loss, or damage to personal property, except where caused by proven negligence.
11.2 The Hirer agrees to indemnify and hold harmless Kawana Indoor Sports and its staff from claims arising from misuse of the court or breach of these Terms.
12.1 Hirers conducting organized leagues, coaching sessions, or commercial activities must provide proof of public liability insurance upon request.
Kawana Indoor Sports shall not be liable for failure to perform obligations due to events beyond reasonable control, including but not limited to natural disasters, government restrictions, or power outages.
Kawana Indoor Sports reserves the right to amend these Terms and Conditions at any time. The latest version will be available upon request or on our website.
These Terms and Conditions shall be governed by and construed in accordance with the laws of QLD Australia
